Review reminder. These Terms describe a draft-support service and do not create a professional surveying, legal, or title relationship.
1. Service and eligibility
TitleDraft provides document-processing and draft CAD support to licensed surveyors, surveying firms, and their authorized survey/CAD personnel. You represent that you are using the service for a professional survey workflow and have authority to act for the firm identified in the intake.
TitleDraft may decline, pause, or cancel work that is outside the published scope, creates an unresolved professional-boundary issue, contains unsupported or unsafe files, or cannot be completed responsibly from the available source material.
2. Draft work product; no professional determination
All outputs are draft work product for review by the responsible licensed professional. TitleDraft is not a law firm, title insurer, surveying firm, surveyor of record, or substitute for legal, title, or surveying review.
TitleDraft does not determine legal effect, title coverage, boundary location, easement location or applicability, survey compliance, recordability, ALTA/NSPS compliance, or final professional treatment. You are solely responsible for verifying source text, calls, units, geometry, closure, assumptions, and the use of every output.
3. Customer source material
You represent that you have the right and authority to upload and direct TitleDraft to process the title report, supporting instruments, CAD reference files, and related information. You must not upload malware, executables, password-protected archives, macro-enabled files, or material whose processing would violate law or another party's rights.
You retain ownership of customer source material. You grant TitleDraft a limited right to host, copy, extract, transform, and otherwise process it solely to provide, secure, support, and maintain the requested service.
4. Scope, timing, and customer cooperation
The $200 introductory standard scope is the scope displayed on the Pricing page and confirmed during intake. Counts are customer estimates and may be checked against the files. A material mismatch, inaccessible instrument, corrupt file, illegible scan, unsafe content, missing information, or unexpected complexity may require clarification, a revised scope, cancellation, or refund.
The standard three-business-day target begins after payment and receipt of usable files. It is a service target, not a guaranteed deadline. You agree to answer reasonable questions and provide available source material needed to complete the work.
5. Payment, cancellation, corrections, and refunds
Stripe processes card payments. TitleDraft does not directly store complete card numbers. Payment is due before production begins.
One correction pass is included for an omitted written-scope item, missing source citation, transcription defect, or agreed formatting defect reported within seven calendar days after delivery. If TitleDraft cannot bring the delivery within the written scope after that correction, TitleDraft will refund the project fee. A professional disagreement, changed instruction, newly supplied document, or ambiguity/missing information in the source is not a drafting defect and may require separate scope.
TitleDraft may cancel and refund an unstarted or incomplete project when responsible performance is not possible. Fees for completed in-scope work are otherwise nonrefundable to the extent permitted by law.
6. Delivery and permitted use
Delivery is normally made through a restricted third-party file-sharing folder. You may use the delivered files within your firm and for the associated professional project, subject to required review. You may edit the draft files and incorporate reviewed material into your own work product.
You may not represent TitleDraft's draft outputs as certified, independently surveyed, legally determined, or professionally sealed by TitleDraft.
7. AI-assisted processing
TitleDraft may use OCR, automated extraction, and AI-assisted tools under operator supervision. These tools can produce errors. Their output is treated as draft assistance and checked against source material within the service scope, but your licensed professional remains responsible for final verification and use.
8. Confidentiality and security
TitleDraft uses reasonable administrative and technical measures appropriate to a small productized service, including private storage and time-limited access links. No system is completely secure, and TitleDraft cannot guarantee that unauthorized access or loss will never occur.
File retention and third-party processing are described in the Privacy Policy. Do not upload material beyond what is reasonably necessary for the project.
9. Disclaimer of warranties
To the maximum extent permitted by law, the website and service are provided “as is” and “as available.” TitleDraft disclaims implied warranties, including merchantability, fitness for a particular purpose, accuracy, noninfringement, and uninterrupted availability. No statement expands TitleDraft's professional role beyond draft support.
10. Limitation of liability
To the maximum extent permitted by law, TitleDraft will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, business, or project opportunity; or claims arising from professional reliance on unreviewed output. TitleDraft's aggregate liability arising from a project will not exceed the amount paid for that project, except where law does not allow that limitation.
11. Indemnity
You agree to defend and indemnify TitleDraft from third-party claims arising from source material you lacked authority to provide, your use of unreviewed outputs, your misrepresentation of TitleDraft's role, or your violation of these Terms, to the extent permitted by law.
12. Changes and contact
TitleDraft may update these Terms prospectively. The version accepted during intake governs that project unless both parties agree otherwise. If any provision is unenforceable, the remaining provisions continue to apply.
